Request to obtain a corporate Licensed Insolvency Trustee licence

Checklist

In accordance with Sections 13 to 19 (inclusive) of Directive No. 13R6, Trustee Licensing, a request to obtain a corporate Licensed Insolvency Trustee (LIT) licence should entail a written request for pre-approval of the name submitted to the Licensing Section of the OSB.

In addition to the aforementioned requirements, the corporate name may include the first letter of the surname of one or more of the trustees or accountants that are practising or have actively practised either as trustees or accountants. The name of a corporate trustee may also consist of the name of a monitor appointed in CCAA proceedings commenced after , and before (reference is made to sections 31 to 33 of Directive No. 13R6, Trustee Licensing).

  1. Once the name has been pre-approved
    1. Fill in Form 3;
    2. Make sure that Articles of Incorporation include the objects of the Corporation (Section 35 of Directive No. 13R6, Trustee Licensing)
    3. Make sure that the by-laws and the shareholders register do comply with provisions of the Directive dealing with Directors and Officers (Section 36) and those dealing with shareholders (Sections 40 and 41).
