The Bankruptcy and Insolvency Act Forms

The Office of the Superintendent of Bankruptcy (OSB) has amended Form 79, Statement of Affairs (Non-Business Bankruptcy/Proposal), which came into force on September 18, 2009. The OSB has removed the requirement to indicate the highest level of education completed by the bankrupt/debtor from Part A of the form under the section titled "Information Relating to the Affairs of the Bankrupt/Debtor."
The OSB has amended the "Estate Information Summary" (EIS) form to include, under Part I (for statistical purposes only), a question regarding the bankrupt/debtor’s highest level of education.
Coming into Force
The revised Form 79 and EIS form come into force on November 19, 2009, and apply to persons to which the September 18, 2009, amendments apply.

Interpretation
- In this Directive,
- "Act" means the Bankruptcy and Insolvency Act;
- "Forms" means the Forms under the Bankruptcy and Insolvency Act;
- "OSB" means the Office of the Superintendent of Bankruptcy;
- "Rules" means the Bankruptcy and Insolvency General Rules.
Authority and Purpose
- This Directive is issued pursuant to the authority of paragraphs 5(4)(c) and (e) of the Act for the purpose of prescribing amendments to Form 79, Statement of Affairs (Non-Business Bankruptcy/Proposal).
Summary
- This Directive amends Form 79 and removes the requirement to indicate the highest level of education completed by the bankrupt/debtor from Part A of the form under the section titled "Information Relating to the Affairs of the Bankrupt/Debtor."
Coming into Force
- The revised Form 79 comes into force on November 19, 2009, and applies to persons to which the September 18, 2009, amendments apply.
