The Bankruptcy and Insolvency Act Forms

The Office of the Superintendent of Bankruptcy (OSB) has amended Forms 65 and 84 to correct technical inconsistencies. The amendments are housekeeping in nature in that they amend incorrect cross-references only, reflecting no substantive changes to the forms.
Summary of Changes
1. Form 65, Monthly Income and Expense Statement of the Bankrupt/Debtor and the Family Unit and Information (or Amended Information) Concerning the Financial Situation of the Individual Bankrupt
Form 65 has been amended to correspond to the schema of the OSB electronic filing system. A reference to section 156.1 of the Bankruptcy and Insolvency Act (BIA) has been removed from line 12 of the form, resolving a discrepancy between the paper version of the form and the electronic version.
2. Form 84, Certificate of Discharge
Form 84 has been amended by replacing an incorrect reference to section 168 of the BIA with a reference to section 168.1 of the of the BIA.
Coming into Force
Directive No. 8R10, The Bankruptcy and Insolvency Act Forms, comes into force on September 20, 2010.

Interpretation
1. In this Directive,
“Act” means the Bankruptcy and Insolvency Act;
“Forms” means the Forms under the Bankruptcy and Insolvency Act;
“OSB” means the Office of the Superintendent of Bankruptcy;
“Rules” means the Bankruptcy and Insolvency General Rules.
Authority and Purpose
2. This Directive is issued pursuant to the authority of paragraphs 5(4)(c) and (e) of the Act for the purpose of prescribing amendments to Form 65, Monthly Income and Expense Statement of the Bankrupt/Debtor and the Family Unit and Information (or Amended Information) Concerning the Financial Situation of the Individual Bankrupt and Form 84, Certificate of Discharge.
