Review of Insolvency Counselling
(for trustees and qualified insolvency counsellors)
As part of the review of insolvency counselling, the Office of the Superintendent of Bankruptcy (OSB) is soliciting comments from trustees and qualified insolvency counsellors. The objective of the review is to ensure that insolvency counselling, required under the Bankruptcy and Insolvency Act, continues to respond to current needs.
Survey
A survey will be administered by Industry Canada’s Audit and Evaluation Branch (AEB). The AEB will contact trustees and qualified insolvency counsellors, either by email or by letter, and provide them with the necessary information to access and complete the online survey.
Participation is voluntary. It should take about 10 minutes to complete the survey. The survey will be conducted between October 9 and November 2, 2012.
If you are a trustee or a qualified insolvency counsellor and you have not received your personal access code by October 16, please contact the AEB at OSB_BSF-AEB@ic.gc.ca.
Randomly selected individuals who filed a bankruptcy or a consumer proposal between March 2011 and February 2012 are also being invited to participate in the review of insolvency counselling by completing a different survey (information forwarded to debtors).
Privacy
Any information provided in response to the survey will be used solely for the purpose of assessing insolvency counselling. Personal information collected through the survey will be protected under the Privacy Act. Any report produced will include only aggregate or summarized data and will not attribute comments to any identifiable individuals.
Results of the survey
The first phase of the insolvency counselling review is an evaluation that includes the two surveys. Results of the evaluation will be available in the summer of 2013. A link to the report will be posted on the Consultation and Review page.
Depending on the findings of the review, the OSB may revise Directive No. 1R3, Counselling in Insolvency Matters.
