Errors Requiring Readvertisement and Erratums

A trade mark will be readvertised in the Trade Marks Journal if it is discovered, prior to allowance, that there is a clerical error in the original advertisement of the trade mark in the Journal, where the error relates to:

  1. the identity of the trade mark
  2. the statement of wares or services
  3. the basis for filing, or
  4. the omission or inaccuracy of a disclaimer statement.

The readvertised trade mark will be subject to the normal opposition period.

Clerical errors which do not affect the above will continue to appear under the Erratum heading in the Journal.
