Where an applicant applies for registration of a trade mark that is a distinguishing guise to which section 13 of the Trade Marks Act applies, he will not be permitted to amend his application by deleting from the trade mark the part thereof that brings it within the definition of "distinguishing guise". It is believed that such an amendment offends paragraph 36(b) of the Trade Mark Rules.
