New PCT-Patent Prosecution Highway (PCT-PPH) pilot project between CIPO and the USPTO and continuation of the CIPO PCT-PPH pilot (CIPO ISA/IPEA)
On January 31, 2013, CIPO will commence a PCT-PPH pilot agreement with the United States Patent and Trademark Office (USPTO), to run for a period of two years, ending January 30, 2015.
Additionally, the PCT-PPH pilot project based on international work products established by CIPO as the International Searching Authority (ISA) and/or the International Preliminary Examining Authority (IPEA) is being continued indeterminately.
The PPH provides accelerated patent prosecution procedures by sharing information between participating patent offices, thus reducing duplication of effort and decreasing patent examination workloads. The PCT-PPH program provides accelerated patent prosecution based on work products done at the international phase, and thereby allows applicants to accelerate patent prosecution at an earlier stage as compared to a traditional PPH agreement.
As with all other PPH agreements, CIPO will process requests for advanced prosecution under the USPTO PCT-PPH program free of charge. Regular fees (Schedule II of the Patent Rules) for requesting examination will continue to apply.
The trial period may be extended if necessary to adequately assess the feasibility of the USPTO PCT-PPH pilot. Both CIPO and the USPTO will evaluate the results of the pilot project to determine whether the project should be fully implemented after the trial period.
Please note that the Offices may terminate the PPH pilot if the volume of participation exceeds a manageable level, or for any other reason (a notice will be published if the USPTO PCT-PPH pilot project agreement is terminated).
In addition to these PCT-PPH agreements, CIPO has one indeterminate PPH agreement with the United States, and eight PPH pilot agreements with Denmark, Finland, Germany, Israel, Japan, Korea, Spain, and the United Kingdom.
