Updated schedule of fees for international patent applications

The Patent Cooperation Treaty (PCT) schedule of fees will be updated, effective January 1, 2017. This update will impact international patent applications filed on or after this date.

The updated PCT schedule of fees will provide new equivalent amounts of the international filing fee, the handling fee and e-filling fee reductions for international applications filed on or after January 1, 2017, as shown below:

Amount expressed in Swiss francs Equivalent amount in CAD before January 1, 2017 Equivalent amount in CAD after January 1, 2017
International filing fee CHF 1,330 $ 1,782 $ 1,792
Fee per sheet over 30 CHF 15 $ 20 $ 20
Handling fee CHF 200 $ 268 $ 269
E-filing fee reduction
  • Item 4(b)
CHF 200 $ 268 $ 269
E-filing fee reduction
  • Item 4(c)
CHF 300 $ 402 $ 404

The affected fees have not changed in Swiss francs, however due to exchange rate fluctuations between this currency and the Canadian dollar, equivalent amounts of these fees have changed. Equivalent amounts are expressed in Canadian dollars and are periodically established by the World Intellectual Property Organization (WIPO). While the Canadian Intellectual Property Office (CIPO) collects these fees on behalf of WIPO, fees to CIPO must be paid in Canadian dollars. CIPO does not accept foreign currency.

Applicants must ensure they consult the applicable PCT schedule of fees. For international applications that were prepared electronically before January 1, 2017 using WIPO’s PCT-SAFE software or ePCT online services, and that will be filed on or after January 1, 2017, applicants should verify these applications have been prepared according to the applicable PCT schedule of fees before filing. A soon-to-be released version of PCT-SAFE will contain the updated PCT schedule of fees.
