1.0 Overview of Canadian administrative status patent data

Canadian administrative status data contains searchable bibliographic and status information for applications open to public inspection, granted patents and public domain documents. The file structure is governed by World Intellectual Property Organization (WIPO) standard ST.36 for the presentation of patent applications and granted patents.

This section will give an overview of what patent information is supplied, the approximate volumes of data, and a description of the file structures.

Patents apply to new inventions, newly developed technology as well as to improvements on existing products or processes. A full description of what constitutes a Patent is described in the Patent Act, however, in brief, a patent is an exclusive right, granted by the Commissioner of Patents under powers given by Acts of government, to exclude others from making, using, or selling your invention in Canada.

New Act Data:

Canadian patent applications filed in Canada after fall under Section 10(2) of the New Patent Act (1989) and are open to public inspection (OPI) after a confidentiality period of 18 months has expired from the earlier of the Canadian filing date or the earliest corresponding foreign patent office priority filing date.

New act Laid-open patent applications are numbered starting with number 2,000,000 which are assigned when filed in the Patent Office.

Canadian patent applications are maintained with payment of annual maintenance fees. Applications are granted or refused after being examined by the Patent Office. A request for examination must be received within 5 years of the filing date for the Patent Office to examine the Canadian Patent application, or the application becomes abandoned. Granted patents are valid for a term of up to 20 years from the filing date, provided the annual maintenance fees are paid. Although not commonly done, granted Canadian patents can be reissued or re-examined to correct errors or defects, within statutory limitations. Canadian patent applications (A1) , Grants (C), Reissues (E) and Re-examined patents (F) all use the 2,000,000 number series as document numbers.

Old Act Data:

Patents filed prior to fall under the old Canadian Patent Act and are not laid open prior to grant. Old Act granted Canadian patents, Re-examined Canadian patent applications, Grants (A), Reissues (B), and Re-examined patents (F) are numbered consecutively from 196,677. The Reissue is given a new number from the original patent.

Old Act patents granted after are currentlyFootnote 1 also in force for 17 years after grant provide the annual maintenance fees are paid.

2.0 Information supplied

Canadian patent data contains information about all patent applications open to public inspection, granted patents and expired applications/patents (public domain).

Where appropriate, volumes will be indicated as well as the volumes of updates and estimates of annual growth. These volumes will be rough approximations and are based on volumes at the time of this document's creation.

2.1 Patent data

2.2 Other Canadian Patent Data

Along with Canadian administrative status data, CIPO also maintains a collection of Canadian patent bibliographic and full-text data which contains bibliographic data, abstract, claims and description text of new applications open to public inspection and newly granted patents. CIPO also maintains a Canadian patent biological sequence listings collection. In addition, patent grant (C) and patent application (A1) images are also available as separate products.

2.3 Admin file data availability

Weekly administrative status data is available weekly on Thursdays and includes the fields and processing dates as outlined in Appendix B.

2.4 Dates

Dates within the data are formatted YYYYMMDD. When the dates cannot be distributed in this format, they will be made available in an unstructured format.

2.5 Country and Office data

The international standard ISO 3166-1, "Codes for the representation of names of countries and their subdivisions – Country Codes", is used to represent countries for postal addresses. The WIPO standard ST.3, Two-Letter Codes for the Representation of States, Other Entities and Intergovernmental Organizations, is used to indicate the name of the country or the office with which the earlier filing was made when patent applicants claim priority filing.

When the country is missing for a postal address, the address information will be provided in an unstructured format.

2.6 Description of the dataset

The administrative status data is compressed using a compression level of normal, a compression method of Deflate and saved as a.zip extension. Please update to the latest extraction software in or to access our data.

Back Files:

Patent administrative status back files are available from 1997. Back file data provides the means to build an initial database.

  • The Back file is approximately 6 Gb.

Weekly Files:

Weekly adminYYYYWW.zip files are made available on Wednesdays.

  • each weekly file contains new and updated applications that have laid opened since the previous week and newly granted and updated patents along with a Log and OpStat files for each. The "Log" file contains a list of all patents extracted and the "OpStat" file provides statistics related to the extraction process.

Expired patents

For patent applications filed on or after (#2,000,000 +), the maximum term of the patent is 20 years from the date the application was filed, after which time it becomes expired.

For patent applications filed before (< #1,262,016), the maximum term of the patent is normally 17 years from the date of issue, after which time it becomes expired.

In the special case of patent applications filed before , (#1,262,017 to #1,999,9999) which had not expired by ; then the maximum term is 17 years from the date on which the patent had issued or 20 years from the filing date, whichever occurs later.

Canada does not currently grant extension of patent terms beyond the expired date.

2.7 Description of XML structure

The Canadian Administrative Status data is provided in XML format, based on WIPO ST.36, as described by the Document Type Definition (DTD) "ca-patent-document". This DTD is the Canadian version of the standard xx-patent-document DTD developed by the European Patent Office. It contains customized elements to accommodate Canadian patent data. These elements are identified by the "ca-" prefix in the element names.

"status" contains the code indicating the current processing state of the Patent/Application. See Appendix B

"dtd-version" contains the document type dictionary version. For clients performing bulk processing of CIPO's ST.36 Patent XML files - either transformation or validation - the public Document Type Definition http://patents.ic.gc.ca/cipo/dtd/ca-patent-document-v2-0.dtd should be downloaded and added to their local XML Entity Catalog. Doing so will avoid an inordinate number of HTTP Get requests for the DTD and the possibility of being refused access to CIPO's web site as a potential denial-of-service threat.

"country" contains the country code (WIPO ST.3) of the publication country (Canada).

Patent applications filed since , are open to public inspection at the expiry of the confidentiality period referred to in subsection 10(2) of the Act.

Applications filed on or after , are made available to the public 18 months after the earliest priority date, or, if there is no priority, 18 months after the filing date, unless the applicant has requested an earlier date of opening to public inspection.

If the application is PCT-originating, then the open to public inspection date will normally be the same as the PCT publication date.Footnote 4

EEER Examination Requested Date The date on which a request that was made to have an application examined was received by the Office. This applies only to applications filed on or after . For applications filed on or after , the request must be made within 5 years from the filing date of the application. For applications filed between and , the request must be made within 7 years from the filing date of the application.
AZWI Withdrawn Application Date The date that an application was withdrawn at the request of the applicant.

NARE Reissue Date

The date that a patent was reissued after the original patent was surrendered by the patentee. For patents that were filed on or after , the patent number remains the same as the original patent. For patents that were filed before , the patent reissues with a new number. In both cases the term of the patent remains the same as the original patent.

A reissue is a mechanism provided for in section 47 of the Act for correcting a defective or inoperative patent, where any error arose from inadvertence and without deceptive intent. Once statutory conditions are met and further examination is undergone, the Commissioner may cause a new patent to be granted.
