Request for the Transfer of a Lease Between Lessors at the Request of the Lessee

Notes:

  1. "Capital Leasing Regulations" means the Canada Small Business Financing (Establishment and Operation of Capital Leasing Pilot Project) Regulations.
  2. To ensure that the Minister's liability is maintained, the lessors should not transfer the capital leases until the Minister has notified both lessors that the transfers meet the requirements of section 36 of the Capital Leasing Regulations.

Lessee

The lessee hereby requests that the capital lease be transferred to the transferee lessor.

Transferor — (Original Lessor)

The transferor lessor acknowledges the request to transfer the capital lease and its responsibility for the payment of 1.25% administration fees due before the effective date of the transfer.

Transferee — (Acquiring Lessor)

The transferee lessor acknowledges the request to transfer the capital lease and its responsibility to the payment of 1.25% administration fees due from the effected date of the transfer. It is the responsibility of the transferee lessor to satisfy itself that the capital lease meets all the requirements of the Capital Leasing Regulations.

Decision by the Minister

  1. The Minister is satisfied that the requirements of section 36 of the Capital Leasing Regulations have been met.
  2. As of this date, for the calculation of the Minister's liability, the original amount of each capital lease is deducted from the portfolio of capital leases entered into by the transferor lessor, and added to the transferee lessor's portfolio of capital leases transferred for the purpose of lease funding.
  3. The Minister is not liable to pay any loss with respect to the capital leases being transferred if the lessors have not complied with the requirements of the Capital Leasing Regulations.
