Health Information Custodians in the Province of Ontario Exemption Order

On November 28, 2005, Governor in Council granted final approval for the following Exemption Order, pursuant to paragraph 26(2)(b) of the Personal Information Protection and Electronic Documents Act (PIPEDA):

Health Information Custodians in the Province of Ontario Exemption Order

The Order exempts from the PIPEDA, health information custodians subject to the Ontario Personal Health Information Protection Act, 2004 (PHIPA), in respect of the collection, use or disclosure of personal health information that takes place within the province. The PIPEDA will continue to apply to the collection, use or disclosure of all personal information outside the province, in the course of commercial activity.
