The Canadian Intellectual Property Office (CIPO) launched three new two-year Patent Prosecution Highway (PPH) pilot programs with Japan, Denmark, and Korea on October 1, 2009.
The Canada-Japan, Canada-Denmark and Canada-Korea Patent Prosecution Highway (PPH) pilots will allow patent applicants from these countries to obtain corresponding patents faster and more efficiently. It also will permit CIPO, the Japan Patent Office (JPO), the Danish Patent and Trademark Office (DKPTO), and the Korean Intellectual Property Office (KIPO) to benefit from work previously done by the other country’s patent office, in turn reducing examination workload and improving patent quality.

These initiatives are similar to the current Canada-United States PPH pilot project between CIPO and the United States Patent and Trademark Office (USPTO). Effective October 1, 2009, the requirements and procedures of the Canada-United States PPH pilot project will be harmonized with these new PPH pilot programs.
These PPH pilot programs are scheduled to end on September 30, 2011; however, as with the Canada-United States pilot, the trial period may be extended if necessary to adequately assess the long-term feasibility of the PPH programs.

The Patent Prosecution Highway Pilot Program
The Patent Prosecution Highway (PPH) is an initiative that provides a means of significantly accelerating examination of patent applications if examination work has already been conducted at another intellectual property office.
Under PPH agreements, if claims of an application have been found to be acceptable by a first intellectual property office, an accelerated examination can be requested at a second intellectual property office. Canadian patent applications will be examined in accordance with the Canadian Patent Act and Patent Rules and the Canadian Intellectual Property Office's (CIPO) Patent Office Practice.
