CIPO will be holding a consultation on subsection 19(4) of the Patent Act from September 8, 2010 to November 8, 2010.

Under Section 19 of the Act, the Commissioner of Patents may grant an authorization for the use of a patented invention by the federal or a provincial government under certain conditions.

The Commissioner is also tasked with setting an adequate amount to be paid to patentees for the use of their patents. CIPO is seeking comments on how this amount could best be calculated.
