1.0 Purpose

The purpose of this bulletin is to identify the authority to exercise certain powers or to perform certain duties under the Weights and Measures Act, the Electricity and Gas Inspection Act, and the Electricity and Gas Inspection Regulations that has been delegated to persons occupying positions within Measurement Canada.

2.0 Position Titles

2.1 In 1996, the delegation of authority to exercise powers or perform duties pursuant to the Department of Industry Act and the Electricity and Gas Inspection Act to persons occupying positions in Measurement Canada was revised to reflect changes to the positions and titles that existed in the organization at that time. The subsection below identifies the changes that have been made to the organization's position titles since 1996.

2.2 The current titles of positions are noted in bold, with a reference to the previous title for each position in parentheses.

  1. President (previously Director General)
  2. Vice-President, Engineering and Laboratory Services Directorate (previously Director, Engineering)
  3. Director, Marketing and Business Operations (previously Director, Operations)
  4. Vice-President, Program Development Directorate (previously Director, Policy, Planning and Program Development)
  5. Vice-President, Innovative Services Directorate (previously Manager, Accreditation)
  6. Regional Director (previously Regional Manager)
  7. Regional Manager, Electricity and Gas (E&G) (as of April 1, 2009)
  8. District Manager, Weights and Measures (W&M) (as of April 1, 2009)
  9. Laboratory Manager (previously Technical Coordinator)

3.0 Delegation of Authorities

The sections which follow outline the legislative authorities delegated to certain positions within

Measurement Canada as they pertain to each Act. In certain circumstances, several positions have been formally delegated wide-ranging authorities. Administratively, however, these delegated authorities are restricted to a specific position or to a position's particular duties and responsibilities. This administrative policy is to be implemented without exception and is effective immediately. This policy will be reviewed and amended periodically to reflect changes in organizational structure and position responsibilities.

4.0 Weights and Measures Act

4.1 Subsection 3(1); authority to approve devices or classes, types or designs of devices for use in trade and Subsection 3(2); authority to approve a device or class, type or design of device for use in trade on a temporary basis while it is being evaluated and set the conditions for such use. This authority is delegated to individuals holding the following positions:

  1. President
  2. Vice-President, Engineering and Laboratory Services Directorate
  3. Director, Approval and Calibration Services Laboratory
  4. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 4.1.1)
  5. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifiers 4.1.1 and 4.1.2)

4.1.1 The granting of approval is restricted to the scope of the particular position's duties and responsibilities.

4.1.2 The authority for the granting of approval by a Laboratory Manager is applicable only in the absence and under the written direction of a Senior Engineer or at the request of the Vice-President, Engineering and Laboratory Services.

4.2 Subsection 12(1); authority to request calibration and certification of standards. This authority is delegated to individuals holding the following positions:

  1. President
  2. Vice-President, Engineering and Laboratory Services Directorate
  3. Director, Approval and Calibration Services Laboratory
  4. Senior Engineers, Engineering and Laboratory Services Directorate (see qualifier 4.2.1)

4.2.1 The authority is restricted to the scope of the particular position's duties and responsibilities.

4.3 Subsection 13(1); authority to designate standards as local standards. This authority is delegated to individuals holding the following positions:

  1. President
  2. Vice-President, Engineering and Laboratory Services Directorate
  3. Director, Approval and Calibration Services Laboratory
  4. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 4.3.1)
  5. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifier 4.3.1)
  6. Regional Director (see qualifier 4.3.2)
  7. Regional Manager (E&G) (see qualifier 4.3.2)
  8. District Manager (W&M) (see qualifier 4.3.2)
  9. Regional Specialist (see qualifier 4.3.2)

4.3.1 The designation of local standards is restricted to the scope of the particular position's duties and responsibilities.

4.3.2 The designation of working standards that are certified as local standards is restricted to the scope of the particular position's duties and responsibilities, where Measurement Canada calibration and certification procedures exist.

4.4 Section 14; authority to replace or restore standards. This authority is delegated to individuals holding the following positions:

  1. President
  2. Vice-President, Engineering and Laboratory Services Directorate
  3. Director, Approval and Calibration Services Laboratory
  4. Senior Engineer, Engineering and Laboratory Services Directorate
  5. Laboratory Manager, Engineering and Laboratory Services Directorate
  6. Regional Director
  7. Regional Manager (E&G)
  8. District Manager (W&M)
  9. Regional Specialist

4.5 Subsection 17(2); authority to furnish each inspector with a certificate of designation. This authority is delegated to the individual holding the following position:

  1. President

4.6 Subsection 38(1); authority to sign a certificate relating to a local standard. This authority is delegated to individuals holding the following positions:

  1. President
  2. Vice-President, Engineering and Laboratory Services Directorate
  3. Director, Approval and Calibration Services Laboratory
  4. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 4.6.1)
  5. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifier 4.6.1)
  6. Regional Director
  7. Regional Manager (E&G) (see qualifier 4.6.1)
  8. District Manager (W&M) (see qualifier 4.6.1)
  9. Regional Specialist (see qualifier 4.6.1)

4.6.1 The signing of a certificate relating to a local standard is restricted to the scope of the particular position's duties and responsibilities.

4.7 Subsection 40(1); authority to apply to extend period of detention. This authority is delegated to individuals holding the following positions:

  1. President
  2. Regional Director

5.0 Electricity and Gas Inspection Act

5.1 Subsection 6(1); authority to maintain the register of contractors. This authority is delegated to individuals holding the following positions:

  1. Regional Director
  2. Regional Manager

5.2 Subsection 9(2); authority to grant temporary dispensation from verification and/or sealing. This authority is delegated to individuals holding the following positions:

  1. Vice-President, Program Development Directorate
  2. Vice-President, Engineering and Laboratory Services Directorate (see qualifier 5.2.1)

5.2.1 This authority is restricted to instances where in-use data is required for the evaluation of an application for device approval.

5.3 Subsection 9(4); authority to grant approval for meters or the class, type or design of meters. This authority is delegated to individuals holding the following positions:

  1. Vice-President, Engineering and Laboratory Services Directorate
  2. Director, Approval and Calibration Services Laboratory
  3. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 5.3.1)
  4. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifiers 5.3.1 and 5.3.2)

5.3.1 The granting of approval is restricted to the scope of the particular position's duties and responsibilities.

5.3.2 The authority for the granting of approval by Laboratory Manager is applicable only in the absence and under the written direction of a Senior Engineer or at the request of the Vice-President Engineering and Laboratory Services.

5.4 Paragraphs 10(a) and 10(b); authority to grant initial accreditation and grant subsequent changes to the scope of a meter verifier's accreditation program. Authority to issue initial and subsequent accreditation certificate. These authorities are delegated to individuals holding the following positions:

  1. Vice-President, Innovative Services Directorate
  2. Program Officer, Innovative Services Directorate (see qualifier 5.4.1)

5.4.1 These authorities are restricted to: granting subsequent changes to the scope of a meter verifier's accreditation program as it pertains to paragraph 10(a); and to issuing a certificate which reflects any changes in scope as it pertains to paragraph 10(b).

5.5 Subsection 11(2); authority to revoke any approval granted under subsection 9(3) or 9(4) or accreditation granted under section 10 for failure to comply with any conditions to which that approval or accreditation has been made subject. This authority is delegated to the individual holding the following position:

  1. President

5.6 Subsection 31(1); authority to direct the destruction or disposition of a meter that has been forfeited to Her Majesty. This authority is delegated to individuals holding the following positions:

  1. President
  2. Regional Director

6.0 Electricity and Gas Inspection Regulations

6.1 Subsection 8(1); authority to certify electricity and gas measuring apparatus. This authority is delegated to individuals holding the following positions:

  1. Vice-President, Engineering and Laboratory Services Directorate
  2. Director, Approval and Calibration Services Laboratory
  3. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 6.1.1)
  4. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifier 6.1.2)
  5. Regional Director (see qualifier 6.1.2)
  6. Regional Specialist (see qualifier 6.1.2)

6.1.1 The certification is restricted to measuring apparatus under the scope of the particular position's duties and responsibilities.

6.1.2 The certification is restricted to measuring apparatus under the scope of the particular position's duties and responsibilities and where Measurement Canada approved calibration and certification procedures exist.

6.2 Section 15; authority to specify conditions to which approvals under subsection 9(4) of the Act are subject. This authority is delegated to individuals holding the following positions:

  1. Vice-President, Engineering and Laboratory Services Directorate
  2. Director, Approval and Calibration Services Laboratory
  3. Senior Engineer, Engineering and Laboratory Services Directorate (see qualifier 6.2.1)
  4. Laboratory Manager, Engineering and Laboratory Services Directorate (see qualifiers 6.2.1 and 6.2.2)

6.2.1 The authority is restricted to the scope of the particular position's duties and responsibilities.

6.2.2 The authority to specify conditions by the Laboratory Manager is applicable only in the absence and under the written direction of a Senior Engineer or at the request of the Vice-President, Engineering and Laboratory Services.

6.3 Sections 25 and 26; authority to issue conditions to which the granting of the initial accreditation is subject, and issue subsequent changes to the granting of the accreditation. Authority to sign the initial and subsequent accreditation certificate. These authorities are delegated to individuals holding the following positions:

  1. Vice-President, Innovative Services Directorate
  2. Program Officer, Innovative Services Directorate (see qualifier 6.3.1)

6.3.1 These authorities are restricted to subsequent changes to the conditions to which granting of the accreditation is subject (i.e., expansion of scope) as it pertains to section 25 and to the issuance of a certificate reflecting changes in conditions within the granted accreditation as it pertains to section 26.

7.0 Revision

The purpose of revision 1 was to:

  1. Reflect changes in Measurement Canada's organizational structure.
  2. Communicate the changes made to position titles.
  3. Provide the added delegation of authorities as published in the Canada Gazette Part I (July 12, 2003) or as authorized by the Minister (July 14, 2003) pursuant to the Department of Industry Act.

The purpose of revision 2 was to:

  1. Incorporate the appropriate titles for the Regional Managers (E&G) and District Managers (W&M)

as of April 1, 2009.

The purpose of revision 3 is to:

  1. Reflect changes in Measurement Canada's organizational structure.
  2. Communicate the changes made to position titles.
  3. Make editorial changes to the document.
