Recently, amendments were made to the Weights and Measures Act and the Electricity and Gas Inspection Act by the Federal Law — Civil Law Harmonization Act, No. 3, which was given Royal Assent on November 29, 2011.

The following provisions were thus amended:

Weights and Measures Act

  • subsection 26(1), before paragraph (a);
  • subsection 35(3), English version only;
  • subsection 37(1).

Electricity and Gas Inspection Act

  • paragraph 10(a);
  • paragraph 10(b), English version only;
  • subsection 26(5), English version only;
  • subsection 31(2);
  • subsection 31(3);
  • subsection 31(5);
  • subsection 35(2), English version only;
  • subsection 36(1), English version only;
  • subsection 36(4), English version only.

The amendments made to the two acts that are administered by Measurement Canada aim to harmonize federal legislative provisions with current civil law. Another aim of the amendments is the rewriting of the French version of federal legislation to take common law into account. There is no direct impact on device inspection (examination) procedures.

The provisions of the affected legislation will soon be published in Part III of the Canada Gazette. Please ensure that your documentation is updated accordingly. It is also anticipated that the Department of Justice will update the legislation that appears on its website.

These amendments differ from those made on March 23, 2011, when An Act to Amend the Electricity and Gas Inspection Act and the Weights and Measures Act was given Royal Assent. Measurement Canada is currently working on finalizing the regulatory amendments that will implement mandatory device examination cycles and the Administrative Monetary Penalty System instituted under the latter Act.
