Measurement Canada announces the registration of the Regulations Amending the Weights and Measures Regulations (SOR/2012-28). This regulatory initiative is not related to the amendments to the Weights and Measures Act, which received Royal Assent on March 23, 2011. It applies only to automatic weighing machines (devices).

The Weights and Measures Specifications SGM-1 (SGM-1) and the Weights and Measures Specifications SGM-3 (SGM-3), which set out the electronic requirements for automatic weighing devices, will be revoked and removed from the corpus of statutory instruments.

The requirements set out therein will be incorporated mainly into Division VI of Part V of the Weights and Measures Regulations. Thus, these electronic requirements for automatic weighing devices will henceforth be grouped together, which will facilitate enforcement of the Regulations.

The regulatory amendments and the order repealing Specifications SGM-1 and SGM-3 will come into force 60 days following registration. Accordingly, the slightly amended requirements will not penalize applicants who submitted their devices for approval. This 60-day period will also allow enough time to revise the approval and inspection procedures and their dissemination to staff performing examinations (inspections) of automatic weighing devices.

The official text of the Regulations Amending the Weights and Measures Regulations will be published in Part II of the Canada Gazette, Volume 146, Number 6, on March 14, 2012.

The new amendments will be integrated into the Weights and Measures Regulations, which are available on the Justice Canada Web site. They will come into force on May 1st, 2012. At that time, make sure to update your documentation accordingly and to remove Specifications SGM-1 and SGM-3 from that documentation.
