CO-ORDINATION AGREEMENT BETWEEN THE DEPARTMENT OF COMMUNICATIONS OF CANADA AND THE MINISTÈRE DES POSTES ET DES TÉLÉCOMMUNICATIONS OF FRANCE REGARDING THE USE OF THE FREQUENCY BANDS 150.050-162.000 MHZ , 451.500-454.500 MHZ , AND 456-460 MHZ PAIRED WITH 466-470 MHZ IN THE ARCHIPELAGO OF SAINT-PIERRE-ET-MIQUELON
1. General
1.1 The basis for co-ordination is the equitable distribution of radio channels preferred by each of the two countries.
1.2 Neither country may use more than 50 per cent of the available spectrum in the frequency bands covered by this agreement.
1.3 Notwithstanding the principle set out in 1.2 above, and until such time as this agreement is revised, Canada has a precarious and revocable right to use the parts of the spectrum that are not allocated to France.
1.4 The term "allocated country" used in this agreement and its appendix means the country to which a part of the spectrum has been allocated.
1.5 This agreement in no way alters the rights and obligations of the administrations under the International Telecommunication Convention, the regulations and agreements of the International Telecommunication Union ( ITU ), and related intergovernmental arrangements.
2. Technical provisions
2.1 Channelling
Each allocated country shall be responsible for channelling the frequencies allocated to it. However, in accordance with provision No. 343 of the ITU Radio Regulations, the emissions must not exceed the limits of the sub-band allocated.
Within the territories under French jurisdiction, channels shall be designated in increments of 12.5 kHz . Channels shall be identified by the reference frequency of the emission in the centre of the channel.
2.2 Power
The French administration undertakes not to operate stations of an effective radiated power over 10 watts for base stations or over 5 watts for mobile stations.
2.3 Class of emission
The French administration affirms that all emissions in the territories under French jurisdiction will be of class 11K0F3E.
2.4 Duplex separation
In the territories under French jurisdiction, duplex separation shall be 4.6 MHz in the VHF band and 10 MHz in the UHF band.
2.5 Equipment
The equipment operating at each station must be certified for use by the administration responsible for that station.
3. Co-ordination procedure
3.1 If either administration wishes to use a frequency in the co-ordination zone contrary to the provisions of this agreement, it must request co-ordination with the other administration.
3.2 If the French administration wishes to use a frequency in a band not covered by this agreement in a territory under French jurisdiction, the French administration shall request co-ordination.
3.3 If an emission within the co-ordination zone is liable to cause interference with a network established in the territory under French jurisdiction, the Canadian administration shall request co-ordination.
3.4 The administration seeking co-ordination shall furnish the information relating to the proposed assignment in the form prescribed in Appendix 1 to the ITU Radio Regulations. This will allow the administration receiving the request to notify the requesting administration of any potential interference with existing stations within its jurisdiction.
3.5 Requests for co-ordination shall be sent at least thirty (30) days before the assignment comes into effect.
3.6 If no objections are received within thirty (30) calendar days after the request is received, the requesting administration can implement the assignment after so advising the other administration.
3.7 In the event of a disagreement, both administrations undertake to make a maximum effort to find a mutually acceptable solution, but neither administration shall be required to submit to the wishes of the other.
4. Co-ordination zone
The co-ordination zone is the area bounded by the parallels of latitude 46°30' and 48°15' north and the meridians of longitude 54°45' and 57°45' west.
5. Transition period
5.1 All existing services that are not operating in compliance with the provisions of this agreement must be in compliance before January 15, 1993.
5.2 Such services are authorized to operate until that date but are not protected and must not cause interference with services operating in compliance with the provisions of this agreement under the jurisdiction of the other administration.
5.3 If a complaint is made, the administration responsible for the station causing interference shall take the necessary measures to eliminate the interference as soon as possible (within 30 days).
6. Special cases
6.1 Emergency measures
In the event of a disaster or other emergency, the French armed forces are liable to implement land mobile equipment with a maximum transmitting power of 25 watts ( ERP ) within the territories under French jurisdiction operating in the bands 150.0500-151.0000 MHz and 156.8375-162.0000 MHz .
6.1.1 To provide for this eventuality, the Canadian administration undertakes the following:
Not to implement high-powered networks in the band 150.0500-150.3000 MHz or networks liable to disrupt the above armed forces radio operations.
To respond promptly to requests for co-ordination in order to make frequencies in the band 156.8375-162.0000 MHz available to the French armed forces as required for creation of operational networks.
To take measures to ensure that Canadian networks are not disrupted by French armed forces networks operating in the above bands within territories under French jurisdiction.
6.1.2 In consideration of the above, the French administration undertakes the following:
To operate only on channels in the band 150.0500-150.3000 MHz and on frequencies in the band 156.8375-162.0000 MHz for which co-ordination has been effected.
6.2 Coast stations
6.2.1 Co-ordination for the use of frequencies covered by the provisions of Appendix 18 of the ITU Radio Regulations, including any future amendments, shall be effected on a case-by-case basis at least three months before the implementation date. These frequencies shall be notified to the International Frequency Registration Board ( IFRB ) but will not be incorporated into the appendix to this agreement.
6.2.2 Assignments of frequencies to coast stations recorded in the ITU Master Register before the signature of this agreement, in accordance with Appendix 18 of the Radio Regulations and future amendments, shall be protected by the two administrations.
7. Scope
The provisions of this agreement apply to land mobile and maritime mobile services within French territories or in coastal waters within twelve (12) nautical miles thereof.
8. Expiration of agreement
This agreement shall remain in effect until it is revised or terminated.
9. Revision of agreement
9.1 The two tables in the appendix to this agreement are integral parts of the agreement and reflect the situation as of the signature of the agreement. The appendix shall be amended as new allotments or new assignments are co-ordinated and consented to.
9.2 This agreement may be revised at any time at the request of either administration. The agreement can be amended through an exchange of letters between the authorized agents of the two governments. This exchange of letters will clearly set out the proposed amendments, additions or deletions and shall state that all other provisions are to remain in effect.
10. Termination of agreement
This agreement can be terminated only if one of the two administrations notifies the other administration in writing twelve months in advance that it intends to terminate the agreement.
11. Registration of agreement
Two originals of this technical agreement were drafted in the French language. The agreement shall come into effect on January 1, 1993.
One original will be held by the Radio Regulatory Branch of the Department of Communications at OTTAWA, and the other by the Direction de la Réglementation Générale of the Ministère des Postes et des Télécommunications at PARIS.
The French version of this agreement was signed at Geneva on the 14th day of December, nineteen hundred and ninety-two.
