Dear Mr. Simmonds:

This is further to my letter of January 8, 1999 acknowledging receipt of additional information to support your application for temporary relief from the spectrum cap in the Golden Horseshoe Area (GHA) of Ontario. We have reviewed this additional information placed on the public record as well as other information requested by the Department, and supplied on a confidential basis, concerning the current and projected traffic of the Clearnet Mike system.

This is to notify you, that based on Departmental review, we are granting approval for Clearnet to exceed the spectrum cap on a temporary basis by up to 3.7 MHz of spectrum in the GHA. This temporary authorization will remain in effect until the end of the third quarter of the year 2000.

Carl Olsen of our Ontario Regional Office will be writing to you to communicate the specific arrangements of this decision.
