Special Coordination Procedure for the Use of Frequency Pair 901.175/940.175 MHz

Recognnizing that primary use of the frequency pair 901.175/940.175 MHz, pursuant to the Interim Sharing Arrangement for the Bands 901-902 MHz, 930-931 MHz and 940-941 MHz between the Federal Communications Commission (FCC) and Industry Canada (IC) remains with the United States;

Considering that Sensus Spectrum LLC (Sensus) in the United States and Paging Network of Canada Inc., in Canada have been granted authority to use this frequency pair in their repective countries, and;

Considering that it is desirable for the FCC and IC to grant authorizations to Sensus (the US licensee) and Paging Network of Canada Inc. (the Canadian licencee) to facilitate communications along the common border between the United States and Canada;

It is acknowledged and understood that:

IC may authorize the use of 901.175/940.175 MHz between Line B, as defined in Section 2 of Arrangement A of the "Above 30 MHz Coordination Agreement",^{Footnote 1} and the Canada/U.S. border (hereinafter "the coordination zone"). The Canadian licensee has authority to use that frequency pair, subject to the following conditions:

• stations established under this special coordination procedure should respect the technical criteria as outlined in the Interim Sharing Arrangement for the Bands 901-902 MHz, 930-931 MHz and 940-941 MHz or any other future arrangement or criteria developed for use of these bands;
• stations established under this special coordination procedure should respect the licensing and frequency conditions and any other conditions imposed by IC with respect to area(s) of operation or any other operating parameters as specified;
• agreement should be reached between the Canadian and U.S. licensees for each proposed Canadian station within the coordination zone before it is placed in operation;
• the U.S. licensee has primary use of the frequency pair 901.175/940.175 MHz within the coordination zone and its use by the Canadian licensee within the coordination zone should not adversely affect any U.S. operations on this frequency pair;
• no service should be offered by the Canadian licensee within the U.S.;
• in the event of harmful interference from Canadian stations established under this procedure within the coordination zone to U.S. stations operating on this frequency pair, the Canadian licensee would take immediate action to resolve the situation, and;
• the authorization is not transferrable without the written consent of both agencies.

This procedure replaces the interim sharing arrangement for the bands 901-902 MHz, 930-931 MHz and 940-941 MHz between representatives of the IC and the FCC to the extent of IC authorization of the use 901.175/940.175 MHz band by Paging Network of Canada Inc. in the coordination zone.

This procedure may be discontinued by either the FCC or IC at any time, but either agency should endeavour to provide three months written notice of such discontinuation. In the case of discontinuation of this procedure, any established stations should be permitted to continue operating with their current parameters but only for a period of time mutually dtermined by IC and FCC.

This procedure is acknowledged as an understanding between the FCC and IC and becomes effective on the date of signature by representatives of both agencies.
