Sharing Arrangement between the Department of Industry of Canada and the National Telecommunications and Information Administration of the United States of America concerning the use of the frequency band 2750 to 2850 MHz for the 10.7 cm solar radio flux monitoring programme at the Dominion Radio Astrophysical Observatory located near Penticton, BC, Canada


The Department of Industry of Canada ("Industry Canada"), and the National Telecommunications and Information Administration of the United States of America ("NTIA"), hereinafter referred to as the "Agencies", have agreed to the following:

1. Scope

1.1 This Arrangement between Industry Canada and the NTIA governs the use of the frequency band 2750-2850 MHz for the operation of the 10.7 cm solar radio flux monitoring programme at the Dominion Radio Astrophysical Observatory (Latitude 49° 19′ 12" North, Longitude 119° 37′ 12" West), located near Penticton, BC, Canada.

1.2 This Arrangement is subject to review at any time at the request of either Agency, the U.S. Department of State or the Department of Foreign Affairs and International Trade of Canada.

2. General Principles

2.1 Both Agencies recognize the value of the frequency band 2750-2850 MHz for the operation of the 10.7 cm solar radio flux monitoring programme at the Dominion Radio Astrophysical Observatory in Penticton, BC, Canada.

2.2 This Arrangement will not preclude the use of the band 2750-2850 MHz by either Agency for allocated radiocommunication services.

3. Cross-Border Coordination of the Radio Astronomy station located at Penticton, BC, Canada and U.S. Meteorological Aids and Aeronautical Radionavigation Stations

3.1 Coordination will be required for any new station or any change to an existing station of the aeronautical radionavigation or meteorological aids services operating within a distance of 150 km from the Dominion Radio Astrophysical Observatory (Latitude 49° 19′ 12" North, Longitude 119° 37′ 12" West), located near Penticton, BC, Canada.

3.2 When coordination is required, it shall be implemented between NTIA and Industry Canada.

4. Information Exchange

4.1 To facilitate the coordination required under this Arrangement, the Agencies shall exchange information as listed in Annex A.
