Application

1. On September 23, 2014, AAL Acquisitions Corp. and GWMC jointly submitted an application to Industry Canada for approval of the Deemed Transfer of the Advanced Wireless Service (AWS) and Personal Communication Service (PCS) spectrum licences set out in Annex A (the Licences).

2. The application was reviewed under the relevant provisions of Client Procedures Circular CPC-2-1-23, Licensing Procedure for Spectrum Licences for Terrestrial Services.

3. The capitalized terms not defined in this decision have the meaning set out in CPC-2-1-23.

Decision

4. The Deemed Transfer of the Licences from GWMC to AAL Acquisitions Corp. is approved.

Rationale

5. The application was assessed against the policy objectives and the criteria set out in Section 5.6 of CPC-2-1-23.

6. Industry Canada notes that AAL Acquisitions Corp. does not hold any other commercial mobile spectrum in the areas under consideration.

7. The Department has determined that the Deemed Transfer of the licences will not impact the ability of existing and future competitors to provide services given that there will be no change in the post-transfer concentration of commercial mobile spectrum in the affected licence areas.
