Subordinate Licences for Spectrum Licences Held by Rogers Communications Partnership to Vidéotron G.P.

Decision Regarding the Subordinate Licences

Application:

1. On July 7, 2015, Rogers Communications Partnership (Rogers) and Vidéotron G.P. (Vidéotron) jointly applied for subordinate licences from Rogers to Vidéotron in the Mobile Broadband Services (MBS) bands in Ottawa, Pembroke and throughout the province of Québec.

2. The application was reviewed under the relevant provisions of Client Procedures Circular, CPC-2-1-23, Licensing Procedure for Spectrum Licences for Terrestrial Services.

3. Capitalized terms not defined in this decision have the meaning set out in CPC-2-1-23.

Decision:

4. The subordinate licence application from Rogers and Vidéotron described above is approved.

Rationale:

5. The application was assessed against the policy objectives and criteria set out in Section 5.6 of CPC-2-1-23.

6. Industry Canada has reviewed the agreement between Rogers and Videotron and notes that the nature of the Agreement is such that both parties retain control of their existing licences and contribute resources and equipment towards a joint network.

7. Rogers and Vidéotron already have a joint Long Term Evolution (LTE) network operating in the Advanced Wireless Services (AWS-1) band in Ottawa, Pembroke and throughout the province of Québec.

8. Approval of these subordinate licences does not change the overall distribution of spectrum holdings in the relevant licence areas, and allows Vidéotron to provide better coverage and offer additional advanced services to a greater number of their subscribers. The Department has determined that the subordinate licences would not impact the ability of existing and future competitors to provide services in the relevant areas.
