Decision regarding the subordinate licence
Application
1. On May 29, 2019, Innovation, Science and Economic Development Canada (ISED) received a joint application to subordinate a licence in the cellular spectrum band between Rogers Communications Canada Inc. (Rogers) and SSi Micro Ltd. (SSi) for several remote communities and outlying areas in the Eeyou Istchee James Bay region of Northern Quebec.
2. The subordinate licence is described in annex A.
3. The application was reviewed under the relevant provisions of Client Procedures Circular CPC2123, Licensing Procedure for Spectrum Licences for Terrestrial Services.
4. Terms not defined in this decision have the meaning set out in CPC2123.
Decision
5. The application to subordinate the licence from Rogers to SSi described above is approved.
Rationale
6. The application was assessed against the policy objectives and criteria set out in section 5.6 of CPC2123.
7. ISED has reviewed the agreement between Rogers and SSi and notes that, for the subordinate licence requested, the primary licensee retains control of its spectrum licence.
8. Approval of the subordinate licence does not change the overall distribution of spectrum holdings in the relevant licence areas, and allows SSi, a wireless service provider, access to additional commercial mobile spectrum. ISED has determined that the subordinate licence would not impact the ability of existing or future competitors to provide services in the relevant areas.
