Canada’s Anti-Spam Legislation enforcement agencies sign memorandum of understanding

The Competition Bureau is pleased to announce that the Commissioner of Competition has entered into a memorandum of understanding (MOU) with the Privacy Commissioner of Canada and the Canadian Radio-television and Telecommunications Commission regarding the implementation of their respective mandates under Canada’s Anti-Spam Legislation (CASL).

The purpose of the MOU is to set out a framework respecting cooperation and coordination in relation to enforcement activities under CASL and the treatment of information that is shared for the purpose of facilitating such enforcement activities. Among other things, the MOU is intended to clarify the role of each agency, given the reality that they may engage in potentially overlapping enforcement activities under their respective legislative mandates and distinct enforcement powers and processes.

Quick facts

  • On December 4, 2013, it was announced that most of CASL and its regulations will come into force on July 1, 2014.
  • Once in force, the law will enable the Bureau to more effectively address false or misleading representations and deceptive marketing practices in the electronic marketplace, including false or misleading electronic messages and website content.
