Patent Prosecution Highway (PPH)—Fast-track examination

If you have a patent application with one of Canada's PPH partners, you may be able to significantly fast-track your patent application.

The Patent Prosecution Highway (PPH) allows you to significantly fast track the examination of your patent application, provided you have a corresponding application with one of our PPH partners.

If you meet the requirements, you can get your first patent examination action faster and at no additional charge to regular fees.

Canadian patent applications will be examined in accordance with the Patent Act and Patent Rules, and the Canadian Intellectual Property Office's (CIPO's) patent office practice.

Global Patent Prosecution Highway (GPPH)—Pilot

To make the PPH process simpler and more accessible, CIPO and 29 other intellectual property offices have partnered in a global PPH pilot that began January 6, 2014. Under the global PPH, you have the option of making a request to any or all of the participating offices based on the work product (in other words, the nature of business at hand such as decision to grant, notice of refusal, etc.), including Patent Cooperation Treaty (PCT) work products, from another participating office. Applicants may make requests to CIPO under the Paris Route PPH (PPH) or the PCT-PPH, depending on the work product from our partner office.

How to submit a PPH request

Submit a letter to CIPO requesting accelerated examination under the PPH or GPPH and include a completed PPH request form and the relevant supporting documents. Information regarding submission of a PPH request.

Conditions

Participating offices will from time to time evaluate and exchange information on the status and effectiveness of the GPPH pilot, and may consider changes to it depending on the evaluation results.

CIPO will process requests for advanced prosecution under the GPPH pilot free of charge. If the GPPH pilot becomes a permanent program, CIPO will evaluate if any fees should apply. Regular fees (Schedule II of the Patent Rules) for requesting examination will continue to apply during the GPPH pilot.

Participating offices reserve the right to limit or end their participation in the GPPH pilot agreements early if the volume of participation becomes unmanageable. A participating office wishing to limit or end its participation must give written notice no less than one month before its withdrawal.
