Licence transfer and subordinate licence decisions

Applications

1. On October 18, 2017, Innovation, Science and Economic Development Canada (ISED) received an application for the transfer of four spectrum licences in the Advanced Wireless Services (AWS-1) band from Bragg Communications Inc. (doing business as Eastlink) to Bell Mobility Inc. (Bell) in Southern Ontario, as well as the transfer of ten spectrum licences in the Broadband Radio Services (BRS) band in Atlantic Canada and Northern Ontario from Eastlink to Bell, and the transfer of ten BRS licences from Bell to Eastlink in the same areas. The applicants also requested 45-day subordinate licences from Eastlink to Bell to facilitate the migration of customers between BRS spectrum blocks. 

2. On November 15, 2017, ISED received an application for the transfer of a BRS spectrum licence in Alberta from Eastlink to Bell and from Bell to Eastlink; and the subsequent subordination of Bell’s BRS licence to TELUS Communications Company (TELUS) in the same licence area.  The applicants also requested a 45-day subordinate licence from Eastlink to TELUS to facilitate the migration of customers between spectrum blocks.

3. The licences are described in annex A.

4. The applications were reviewed under the relevant provisions of Client Procedures Circular CPC-2-1-23, Licensing Procedure for Spectrum Licences for Terrestrial Services.     

5. Capitalized terms not defined in this decision have the meaning set out in CPC-2-1-23.

Decision

6. The Licence Transfers and subordinate licence applications described above are approved.

Rationale

7. The applications were assessed against the policy objectives and criteria set out in section 5.6 of CPC-2-1-23.

8. ISED notes that the Licence Transfers will not result in a significant change in spectrum concentration in the licence areas.  Furthermore, the requested AWS-1 Licence Transfer involves spectrum that is not currently being used to provide services and will offer Bell an opportunity to put such spectrum to use for the benefit of all Canadians. 

9. ISED has determined that the requested Licence Transfers will not significantly impact the ability of existing or future competitors to provide services given that the transfers will not substantially change the post-transfer concentration of commercial mobile spectrum in the affected licence areas.
